Camaïeu’s customer file will not be sold at auction

The auctioneer in charge of the auction of the assets of Camaïeu renounces the lot concerning the data of four million people.

The auction of the latest Camaïeu assets will not include the customer file of the female clothing brand liquidated at the end of September. “Given the constraints related to compliance with the RGPD legislation [General Data Protection Regulation], in agreement with the bodies of the legal proceedings, we were forced to give up the auction of this lot”, specifies Patrick Deguines, auctioneer of Maison Mercier, in charge of this judicial sale scheduled for Wednesday, December 7, at 2 p.m., in Vendeville, near Lille (North), two months after the final closure of the 511 Camaïeu stores and the dismissal of its 2 100 employees.

This long -awaited vacation includes around twenty lots, including clothing, 92 exhibition models, 2,500 yoga carpets and the sale of the Camaïeu brand. This last lot initially included the customer database from the loyalty card operated by the clothing brand. Or more than four million personal data. For the past few days, a controversy has been having been informed: this transfer should have been subject to the consent of each of the interested parties.

According to the National IT and Freedom Commission (CNIL), authority responsible for the protection of individual freedoms, the “protective rules of personal data do not prohibit a company from yielding its file to another company”. However, in accordance with the GDPR, in force since 2018, the company must “prior to this transfer” inform the customer of his “faculty” to oppose it and have “collected his express consent”. These “legal obstacles” prevent this file from selling, specifies Mr. Deguines. The decision was taken “as a precaution”, taking into account the “legal risks incurred”, explains Maître Yvon Perin, legal representative responsible for the liquidation of the Camaïeu brand.

Priced at 500,000 euros

Will this have an impact on the sale of the Camaïeu brand? “Only 20 % of bidders”, who, Monday, December 5, expressed their interest by depositing a deposit of 50,000 euros, were interested in the customer file, nuance Mr. Deguines. This withdrawal is however “regrettable”, is suitable for M e perin. The value of the name of the brand, its 115 brands and the 110 domain names, risks being reduced by the prohibition to use this database to relaunch Camaïeu. However, the price has not been changed: it will be 500,000 euros. On November 2, an auction of twenty prizes of Camaïeu clothing had brought back more than 3.8 million euros. Noz, destocking brand, had acquired the vast majority of products.
