The profile organization sent a request to Roskomnadzor with a request to explain the possibility of classifying a person’s aura to his biometric personal data. Roskomnadzor experts replied that according to the current legislation (Article 11 of the Federal Law “On Personal Data”), this is in principle not prohibited.
The applicant’s issue mentioned the technology of gas -discharge visualization (GRV), based on the effect of Kirlian (see “Method of gas -discharge visualization in the study of the physical and mental status of a person”, which makes it possible to observe the aura of a person, register its stable and repeated properties on a special film , and personal information, which is a few by means of such equipment, is programmed to process and store in the computer’s memory.
As stated, the subject of such information can be identified according to the unique parameters of the human life (mental) energy – the energizes of the individual’s aura recorded in the photograph – Cyrillianography.
In this regard, the applicant asked to explain whether information refers in the form of the GRV imitation of its thin-material shells (bodies) recorded using modern means of technology, to the general and (or) biometric categories of personal data from the point of view of the provisions of the Federal Law of 07/27/2006 No. 152-ФЗ “On Personal Data”.
The experts of Roskomnadzor got acquainted with the topic of the question and sent the following answer:
We inform that in accordance with paragraph 1 of Art. 3 of the Federal Law of July 27, 2006 No. 152 -ФЗ “On Personal Data” (hereinafter referred to as the Law) Personal data is any information related to a direct or indirectly defined or determined individual (personal data subject). If the information specified in the circulation corresponds to the determination specified in paragraph 1 of Art. 3 of the law, this information will be personal data. In addition, we inform that the criteria for classifying personified information as biometric personal data, as well as the legal grounds for processing such personal data, are enshrined in Art. 11 of the Law.
