The deputies, together with Senator Andrei Klishas, introduced a draft amendments to the Criminal Code of the Russian Federation for consideration by the State Duma, providing for confiscation of property, which was obtained as a result of cybercressions. This was stated by the head of the Duma Committee on Security and Combating Corruption Vasily Piskarev.
The bill proposes to supplement the item “A” of part 1 of Article 104.1 (“Confiscation of property”) of the Criminal Code of the Russian Federation Articles 272-274.1. This will make it possible to confiscate the property obtained as a result of unlawful access to computer information (Article 272), the creation, use and distribution of malicious programs (Article 273), violations of the rules of operation, storage, processing or transmitting computer information (Article 274) and unlawful effects) for critical information infrastructure of the Russian Federation (Article 274.1).
The explanatory note notes that recently “there has been an active penetration of crime into information technology and telecommunications”, the number of fraudulent actions in the credit and financial sphere has been growing. As a result, the number of victims, especially the elderly, is growing.
“The introduction of confiscation of unrighteously acquired property of cybercriminals will be the restoration of justice and will allow these funds to compensate for damage to the victims,” said the author of the amendments, the chairman of the State Duma Committee on Security and Combating Corruption Vasily Piskarev.
Note that now the confiscation of property is possible for killing with aggravating circumstances, intentional infliction of grievous bodily harm with aggravating circumstances, the production and sale of fake money, the committing of the terrorist attack, theft or extortion of drugs, the Stateise and other crimes.
