Self -defense of a victim of domestic violence? Crime coldly calculated for financial reasons? The two theses collide in the case deemed from Wednesday 2 to Friday November 4 before the Assize Court of Lyon, with contradictory elements which make the outcome of the uncertain trial.
Accused of murder by spouse, Rose Filippazzo, 50, says that she wanted to put an end to an accumulation of physical and moral suffering, killing her husband, Michel Zirafa, with a ball in the head during her sleep , on September 16, 2018, in their house in Thurins (Rhône). Defended by Janine BonaggiNTA, former lawyer for Jacqueline Sauvage, the accused hopes to be able to compare herself to the one who had invoked invivable domestic violence to justify the three shots drawn in the back of her husband. “I am hopeful of making the parallel. This woman suffered, she lived under a total grip,” announces M e bonaggiunta.
The first appearances play against her client. Rose Filippazzo is distraught with a neighbor on September 21, 2018, saying that she has just discovered her husband’s body, lying on the floor, near the living room sofa. She tells the gendarmes that her husband left the home in the middle of the night, after a common dinner together. She sent SMS to pretend to get her news. In reality, the murder was committed five days earlier, which she admits in her final hearing in police custody, confronted with several disturbing clues, including the fact that she used several telephone lines, one of which was opened on day facts. Investigators also suspect her for having consulted on the internet on firearms on the fire, and of having tried to order ammunition – which she disputes.
Rose Filippazzo had been leading a double life for several months, remaining in an episodic relationship with her husband, at the marital home, and frequently finding her lover in a specially rented cottage. Investigators discover that the victim had contracted, in 2017, a capital insurance of 200,000 euros for the benefit of his wife. After the discovery of his wife’s adulterous link with the baker of the neighboring village, he had changed beneficiary, in July 2017. What Rose Filippazzo ignored. The widow opens a trunk to the bank, and claims the payment of life insurance a few days after murder, with an eagerness that gives investigators the printing of a Machiavellian plan. In telephone listening, her lover calls her “black widow”. Which accentuates the suspicions of the authorities.
