Nasser Al-Khelaïfi case: a controversial memorandum of understanding

It is a curious four-page document which is at the heart of the case between Qatari Nasser al-Khelaïfi, known as “Nak”, boss of Paris Saint-Germain and the group Bein Media, and the Franco- lobbyist Algerian Tayeb Benabderrahmane. Costed on July 10, 2020, by Mr. Benabderrahmane, represented by the Parisian law firm Oplus, and one of the lawyers for “Nak”, Renaud SEMERDJIAN, this “transactional protocol of understanding was supposed” to put an amicable end “To the” dispute “between the two men” relating to the illicit appropriation by Mr. T. [Mr. Benabderrahmane] of confidential documents to the damage of the victim [Mr. al-Khelaïfi] “.

Le Monde learned of this document, “governed and interpreted in accordance with French law”, which lists a series of “declarations and commitments”, and which since September 2021 has challenged Benabderrahmane before the judicial court of Paris. The lobbyist believes he has initialed him under the constraint when he was under residence supervised at the intercontinental hotel in Doha, with a ban on leaving Qatar, after five and a half months of “arbitrary” detention in the emirate.

In the preamble to this agreement, “Mr. T. admits having illicitly appropriated confidential documents which he notably altered/falsified the object and the content”. The nature of these famous documents, “having to be returned to the day of the signature” of the protocol, is not specified. Reference is made to “audio, video recordings, photos on all supports of any kind whatsoever, of all writings/confidential, original and/or copies (…) in direct or indirect with the person and/or life family, professional or public and/or the activity of the victim and or the companies he represents, detained directly or indirectly by Mr. T. or his affiliates [“member of his family and any person who has been aware of the actions of Mr. T. “and” anyone in possession (…) or having participated directly or indirectly in obtaining, the custody or the use of confidential documents “].”

An annex list three USB keys and a “black external hard drive” “in the possession” of “Mr. T.” and/or his “affiliates” and that Mr. Benabderrahmane undertakes to restore fully to Mr. Al-Khelaïfi.

As a letter of June 15, 2020, three supports were given by Olivier Pardo, the lawyer for Mr. Tayeb Benabderrahmane and the Moroccan Hicham Karmoussi (who would have signed two protocols) – former man of confidence “NAK” and presumed source of said documents – in Francis Szpiner, one of Mr. Al -Khelaïfi’s lawyers. Me Pardo claims to ignore its content. Three supports are presented in two photos attached to the mail. Contacted, m e did not wish to comment, being “subject to professional secrecy”.
