Promises all in nuance. In terms of immigration, Wednesday, October 26, on France 2, Emmanuel Macron sought to defend his action, undertook to expel more people in an irregular situation without promising miracles. The subject of forced distance returned to force in the news following the murder, on October 14, in Paris, of a young girl, Lola, for whom the main questioning turns out to be an undocumented Algerian which had been the subject of an obligation to leave French territory (OQTF) but did not have a judicial history. The right and the extreme right have taken hold of this drama to accuse the government of helplessness, while, in the first half of 2021, according to the last figures available, 5.67 % of the pronounced OQTFs were executed.
Questioned on his 2019 statements in the weekly weekly current values - to whom he had said he had the objective of having 100 % of the OQTFs issued by the Administration -, the Head of State recognized that the promise was not tenable. “Even those to whom we do not give the titles [of stay], [to whom] we do not confirm their right to stay on the territory, we have a lot of trouble referring them,” he said. He wanted to distinguish “two types of OQTF”: those issued after a title refusal or the rejection of an asylum request to foreigners “that we do not put in prison”, and those delivered to foreigners who “Disturbing public order”. It is this last category, “those who are the most dangerous”, on which the president wants to concentrate the means and reach 100 % of the distance from the distance.
“In two years, we have managed to return 3,000 people who disturbed public order,” said Macron, highlighting the policy of the Minister of the Interior, Gérald Darmanin, who asked the Prefects to primarily implement the distance from foreigners. Asked about the amalgam made by the minister between foreigners and delinquent, the President of the Republic defended himself from any “generalization” and argued that he “will never make an existential link between immigration and the insecure “. However, he advanced that in Paris, “where we have a high concentration of this illegal immigration (…), at least half of the crime is the result of foreigners”.
“Simplify the procedures “
The Head of State has promised a “in -depth (…) reform to simplify procedures”, during the immigration bill, which must be examined “in the first semester” 2023 and preceded by a Debate in Parliament in “The next few weeks”. If Mr. Macron has not extended to the elements that would make up the future text – which will constitute the second immigration law since his first election – he notably said he wanted to “harden the rules” and “accelerate” in particular the examination Asylum requests. Elements of the project have also already been distilled in recent months, such as the lengthening of the duration of the OQTF, the lowering of the voluntary departure period or the overhaul of the National Court of Asylum.
