The Court of Justice of the Republic, the only body empowered to judge ministers in practice, examined for two days the accusations of “embezzlement” and “illegal taking of interest” against the ex -Membre des governments Valls and Ayrault.
Five siege judges, twenty-four parliamentarians, two general prosecutors and the prestigious decor of the Court of Cassation: the system put in place to judge, Wednesday 19 and Thursday 20 October, the former Secretary of State then Minister Delegate to veterans under François Hollande, Kader Arif, facts of “illegal taking of interest” and “embezzlement of public funds” for a prejudice estimated at 60,000 euros, is far from the ordinary of the correctional courts. But the Court of Justice of the Republic has been, since 1993, the only institution empowered to judge acts committed by the ministers during their mandates.
In March 2014, Kader Arif explains that, despite his already long career, he needs to improve himself in terms of communication. “I wanted to be comfortable in front of a microphone, mastering my voice”, in particular with the perspective of the commemorations of the allies’ victory over Germany on May 8, 1945, he assures. He therefore asked his brother Aissa, who recommends a Toulouse animator, Boris Georgelin, whom he regularly employs under the intermittent status of the show. It is he who will sign the contract, passed without tenders: 60,000 euros, for six sessions of “media training”. Mr. Georgelin is however a simple provider of All Access, a company managed by Aissa, the brother of Kader Arif. Under a management prohibition, he uses his son as a nominee.
At the bar, the host – who cannot deposit under oath, being indicted in the criminal component of the file – is not mistaken: “[It’s] because my name was Georgelin, My name was not ARIF “, that he is responsible for signing the contract in place of his employer. Aissa ARIF, also quoted as a witness, has chosen not to come, so as not to risk in writing when he is also indicted.
“Being a minister up to the task”
Kader Arif insists his ignorance. “I did not know who were the leaders or the shareholders [of the company All Access], he says. What was important to me was to be a minister on the task.” For him, the fault is the responsibility of its services, which should have made the necessary checks. As for his brother, he “betrayed” his confidence by not sharing this conflict of interest to him. And if he has only carried out one of the six “media training” sessions planned, it is because of his schedule and family problems. The total invoice is however duly paid by the ministry in April 2014.
