Superior Council of Magistracy whitens national financial prosecutor’s office

No disciplinary fault is retained against Eliane Houlette, the ex-patron of the PNF, and Patrice Amar, vice-prosecutor, after two years of soap that fueled tensions between the magistrates and the Minister of justice, Eric Dupond-Moretti.

And at the end, all the protagonists are bleached … except Eric Dupond-Moretti. Both a symbol and the crisis between the magistrates’ unions and the Minister of Justice, the disciplinary proceedings engaged against the magistrates of the National Financial Prosecutor’s Office (PNF) are in their epilogue. In two opinions rendered Wednesday October 19 to the Prime Minister, Elisabeth Borne, the Superior Council of the Magistracy (CSM) concluded, after eighteen months of instruction and after public contradictory hearings, that Eliane Houlette, The ex-patron of the PNF, and Patrice Amar, vice-prosecutor of the PNF, “committed any disciplinary fault”.

Already, the case which had shaken in June 2020 this prosecution at the forefront of the fight against corruption and great financial delinquency had largely deflated. The “Barbouzes” methods “stigmatized by lawyer Dupond-Moretti, a few weeks before his appointment as Minister of Justice, proved to be a preliminary investigation carried out legally. It was the requisition by the FADETTES PNF, the telephone statements, of lawyers in the entourage of Nicolas Sarkozy to find out who had informed him that his line was on listening, in the judicial information open to Suspicions of Libyan funding from his 2007 electoral campaign. A leak had led the ex-head of the State to take a telephone line under an assumed name, Paul Bismuth, in order to communicate with his lawyer, Thierry Herzog.

These listenings have uncovered facts of influence and corruption traffic for which Nicolas Sarkozy has been condemned, but the original investigation on the Libyan affair is still in progress. As for the preliminary investigation open to find the mole, it did not give anything and was closed in early 2020.

But the great political emotion and the confusion maintained between the duration of the investigation (six years) and the amplitude of the monitoring of the fadettes (a few hours) had imposed a reaction. Nicole Belloubet, then Minister of Justice, seized the General Inspectorate of Justice to shed light on this investigation. The machine was launched.

Despite a report concluding that there is no irregularity on the way in which the financial prosecutor’s office had carried out this procedure, a predisciplinary investigation against PNF magistrates was ordered under the authority of the successor of M me Belloubet, M. Dupond-Moretti.

Great managerial tension

Finally, the disciplinary training of the CSM responsible for the magistrates of the prosecution was seized of facts unrelated to the “scandal of the FADETTES du PNF”. It is undoubtedly in a spirit of appeasement, after two years of tensions between magistrates and Keeper of the Seals, that the representative of Elisabeth Borne at the hearings had required, at the end of September, the absence of sanction, while retaining certain shortcomings .
