State Duma Introduces Unreliable Operator Sign to Tackle Data Leaks

Boris Cherneshov, Deputy Chairman of the State Duma from the LDPR faction, has submitted a proposal to the Minister of Digital Development, Communications and Mass Communications, Maksutu Shadaev, requesting the creation and implementation of a special symbol to designate companies that have experienced personal data breaches. In his letter, Chernyshov states, “I request that you consider the possibility of designing and implementing a graphic symbol for ‘Unreliable Personal Data Operator,’ as well as labeling companies that have allowed the leakage of personal data of their customers.”

The intention behind this proposal is to assist Russian citizens in making informed decisions about which companies they can trust. Additionally, Chernyshov believes that implementing this symbol will help raise awareness among vulnerable groups, including minors and the elderly, while also incentivizing personal data operators to prioritize the safeguarding of their customers’ information.

Chernyshov highlights that personal data breaches have affected not only smaller entities but also prominent Russian companies such as delivery services, food and parcel providers, medical organizations, online stores, educational institutions, and representatives of the telecommunications industry.

A law was enacted in September 2022 that mandates operators to report incidents of personal data leakage to Roskomnadzor, the federal executive body responsible for overseeing communication, information technology, and mass media. This requirement entails two stages: operators must first notify Roskomnadzor within 24 hours, providing details of the compromised data and a contact person. Subsequently, within three days, they must submit a follow-up report outlining the findings of their internal investigation.
