The Ministry of Cyphra of the Russian Federation has recently submitted a draft government decree regarding the procedures for conducting a survey of cross-border communication lines. This draft has been published on the portal of draft regulatory legal acts as part of the ministry’s efforts to ensure proper regulation in this area.
Under the proposed regulations, the examination of these communication lines will be carried out by Roskomnadzor, the supervisory service responsible for overseeing the telecommunications industry. The examination process begins when operators, owners, or other entities in control of technological communication networks, traffic exchange points, or cross-border communication lines notify Roskomnadzor of their compliance with the requirements for cross-border communication lines.
Upon receipt of the notification, the employees of Roskomnadzor will study the documentation provided by the operators or owners. Following this, they will proceed to conduct an examination of the communication lines on-site, inspecting them firsthand. It is required that this examination is completed within 28 business days from the date of receipt of the notification. Specifically, the examination period should not exceed three business days for a documentary review and 15 working days for a field survey.
To facilitate the examination process, operators and owners are required to provide certain documents. These documents include:
- Documents establishing access control, access passwords, and the procedure for admission to the equipment
- Traffic missing schemes
- Documents confirming the establishment of security zones for the communication lines/facilities
- Information regarding the communication cables involved, locations of connecting couplings, and other relevant technical details
- Certificates of conformity for the means of communication used
- Operational documentation on the communication line crossing the state border
Once the examination has been completed, a conclusion is issued. If any discrepancies between the cross-border communication lines and the requirements are identified during the examination, the conclusion will specifically indicate which requirements have not been met.
