According to the Court, the public interest attached to the disclosure of this information by Mr. Halet prevails over all of the damaging effects resulting from it.
The European Court of Human Rights recognized that Raphaël Halet, French sentenced to Luxembourg for leaking documents as part of the “Luxleaks” tax evasion scandal, was a whistleblower and condemned Luxembourg to pay him damages.
The Court, which had dismissed Mr. Halet at first instance, estimated in a judgment of the Grande Chamber, published Tuesday, February 14, that the public interest attached to the disclosure of this information won over the whole damaging effects resulting from it.
