Judge Alexandre de Moraes evaluated 1,406 files of people suspected of being involved in the invasion and ransacking of power centers in the capital, the STF said in a statement on Friday. 464 of them will be temporarily released.
More than 2,000 people have been arrested since January 8, when thousands of supporters of the ex-right president Jair Bolsonaro stormed the presidential palace, the Congress and the Supreme Court, vandalizing furniture, invaluable works of art and part of the infrastructure.
The assault occurred a week after the coming to power of the left icon Luiz Inácio Lula da Silva, winner of the presidential election last October.
In the days following violence, justice has determined that special cases such as the elderly, pregnant women and mothers of young children, would be released for humanitarian reasons before being heard.
m. Moraes, on the other hand, ordered the preventive detention of 942 people, arguing that there is evidence that the detainees participated in acts of “terrorism”, in an association of criminals, in the violent abolition of the rule of law and at a coup.
For the judge, detainees may have committed “illicit and extremely serious” acts, and pre -trial detention, of an indefinite duration, is necessary to “guarantee public order and ensure the effectiveness of surveys”.
Electronic bracelet and prohibition to use social networks
However, he spoke in favor of the provisional release of 464 other prisoners, under certain conditions such as wearing an electronic bracelet and the prohibition to use social networks.
Regarding these cases, Mr. Moraes indicated that, although there are strong indications of responsibility and participation in crimes, in particular in the attempt to overthrow a legally constituted government, the evidence was not collected so far.
Jair Bolsonaro is the subject of an investigation by the Brazilian authorities who suspect him of being the instigator of the riots, and sixteen investigations for electoral irregularities.
The former president, who went to the United States two days before the transfer of power, rejects all these accusations.
