States cannot derogate from the prohibitions of the European Union (EU) concerning seeds to neonicotinoids. In a Judgment rendered Thursday, January 19, the Court of Justice of the European Union (CJEU) deemed illegal the derogations granted to prohibited pesticides, when they are applied to preventive seed treatment – like C ‘ is the case for neonicotinoids on the beet.
The project of reautunate decree, for 2022, the use of the main neonicotinoids on the beet had been put in consultation at the end of December. It followed a favorable decision rendered a week earlier by the supervisory board responsible for instructing requests for derogation from the use of these products – advice made up of elected officials, agricultural unions, representatives of the sector, NGO, etc.
These pesticides prohibited in Europe since 2018 had already been the subject of a derogation for 2021, due to the threat of beet jaundice – a viral disease transmitted by a aphid. Last year’s harvest has undergone major losses due to the use of non -compliant herbicides, in error in the products used by many planters. These “phytotoxicity incidents” touched, according to data presented to the supervisory board by the Ministry of Agriculture, 1,139 farms on all beets regions, for a total of nearly 15,000 hectares, or more than 1 , 2 million tonnes of beets, destroyed or recycled in fuel.
