Seven detainees of the Marseille establishment seized the administrative court to protest, in particular, against the impossibility of opening them in hot weather.
They suffocated all summer in their cell, without being able to open the window: seven women detained at the Penitentiary Center of Baumettes 2 seized the administrative court of Marseille on September 9. They require in summary proceedings the appointment of an expert in hygiene and sanitation with the mission of measuring the consequences of the device of the fog windows installed on three floors in 87 cells in the women’s district and in thirty cells in the district arrivals men.

Their lawyer, M e Emmanuel Docteur, is on the initiative of this procedure when he defended, in early August, women detained, prosecuted disciplinary by the administration for having degraded their window. In the incident reports drawn up by prison frameworks and which have earned these women five to ten days of “dungeon”, purged in the disciplinary district and the restraint of 330 euros on their nest eggs, they explain why they broke the window . We read: “I need to breathe”, “I needed air” or “I felt anxious. It’s inhuman and scary”.
All say that it is not cheerful to heart that they have degraded their window. “We cannot ventilate the cell, we take advantage, when it is a good supervisor, to leave the door open at [the time of] the bowl,” responds one of them to a questionnaire prepared by M E Doctor, with a view to the procedure. 2>
Protests from neighbors
According to the lawyer, “these disciplinary procedures penalize their penitentiary career and cush up the reductions in pain”. These anti -gross windows were installed after the strong protests from the neighbors whose houses and gardens are located on the other slope of the valley, on the other side of the Morgiou chemin. Put into service from 2017, Baumettes 2 have higher buildings than those of historic Baumettes which did not exceed the surrounding wall.
The cells of the top floors of the women’s and two in the neighborhood of men’s arrivals – further from the road – offer a view of the neighboring pavilions. Local residents have denounced direct apostrophes made by detainees. Eliane Gastaud, spokesperson for the collective of neighbors who brings together 280 households, in book some examples: “Are you clean your panties?
