Levrault judge did not commit disciplinary fault by denouncing Monegasque justice

The disciplinary instance of the Superior Council of the Magistracy whites the ex-investigation judge of any breach and closes this chapter opened by Eric Dupond-Moretti in 2020.

The Superior Council of Magistracy (CSM) laundered, Thursday, September 15, of any disciplinary breach the ex-instruction judge in Monaco Edouard Levrault. It is the epilogue of a committed showdown, in June 2020, by Eric Dupond-Moretti, then lawyer of the leader of the Monegasque judicial police indicted by this French magistrate when he was detached in the principality. He had announced criminal and disciplinary proceedings by pressing following comments made in a France 3 program by Mr. Levrault, ousted a year earlier from Monegasque justice while he led an investigation on a case implying close to Prince Albert.

Two years of procedures and a lot of noise for nothing? Not totally … There remains a severe observation of this harsh observation to the hollow of the eleven pages of the decision of the Disciplinary Training of the CSM: “By ordering, on July 31, 2020, an administrative inquiry against [Mr. Levrault] , after having expressed himself on June 12, 2020, as a lawyer of one of the people charged by the latter (…) The Keeper of the Seals, Minister of Justice was in an objective situation of conflict of conflict Interests. “

The file was deflated

A situation that the CSM judges without consequences for the disciplinary procedure, since without “impact on the conditions of impartiality and loyalty in which the inspectors have accomplished their mission”. But which sounds like a reminder less than three weeks before the investigation committee of the Court of Justice of the Republic (CJR) decides on the dismissal or the referral of Eric Dupond-Moretti before this judgment jurisdiction. It is currently simply indicted for “illegal taking of interest”.

The twelve members of the training in charge of the magistrates of the siege within the CSM, a constitutional institution responsible for ensuring the independence of the judicial authority, rejected the nullities raised by the lawyer of Mr. Levrault, namely This conflict of interest, and the illegality of referral to the disciplinary body by the Prime Minister. The lifting of these two mortgages make two other disciplinary hearings open under the same disputed conditions possible. Patrice Amar, first vice-prosecutor at the National Financial Public Prosecutor’s Office (PNF), and Eliane Houlette, the ex-patron of the PNF, are summoned respectively on September 20 and 21 and September 26 and 27 before the formation of the CSM devoted to the magistrates of the Parquet. The PNF magistrates had been the subject of very virulent attacks on the part of the former tenor of the Assizes, evoking “Barbouzes methods”, shortly before being appointed Minister of Justice on July 6, 2020.
