Technical control of two-wheelers: after its suspension, decree was repealed

The decree, promulgated in August 2021 and which provided for the implementation of the measure in 2023, had been suspended in the aftermath of his publication by Emmanuel Macron. He was repealed Tuesday, July 26 by a new decree published in the “Official Journal”.

After his suspension by the Head of State last summer, the measure has just been ratified. The decree relating to the technical control of two-wheelers, which provided for its implementation in early 2023, was thus repealed by a new decree published Tuesday July 26 in the Official Journal.

The Minister Delegate in charge of Transport, Clément Beaune, must receive the same day the associations of bikers, said his cabinet at the France-Presse agency. The subject remains thorny while the European Union requires the implementation of the measure in its member states since 2014, with an entry into force which was expected at the latest at 1 er January 2022.

But, in August 2021, the announcement of the implementation of such a measure in France had been the subject of many tensions and mobilized bikers in the street. The decree promulgated by the government provided for the entry into force of the technical control of two-wheelers in stages by 2023.

Faced with the general bronca, Emmanuel Macron had announced, the day after his publication, the suspension of the decree. “After discovering this measure, the President of the Republic decided that it was not the time to annoy the French,” explained an executive advisor.

Three NGOs engaged for road safety – breathing, the scooter and Paris without cars – nevertheless used the initial decree, requesting the cancellation of its suspension and the obligation, for the State, “to guarantee the Implementation of technical control (…) as soon as possible “, stressing that such a measure would reduce the mortality of bikers, as well as noise and atmospheric pollution.

The Council of State had proved them right last May and estimated that the postponement of the entry into force of the technical control of two-wheelers of more than 125 cubic centimeters beyond 1 er October 2022 “For the oldest vehicles” was “not justified”.

Opponents of technical control await, despite this decision, a new decree with alternative measures on road safety, pollution and noise, promised in November 2021 by former Minister of Transport Jean-Baptiste Djebbari, who had assured that such a decree would make it possible to obtain the exemption from the European obligation.

Environmental associations had notably called the new government, during its appointment, to impose technical control from the 1 er October and not to give in to the “biker lobby”.
