The writer Florence Porcel accuses the former TF1 star of having imposed a sexual intercourse in 2004 and a blowjob in 2009. The facts of 2004, classified without follow -up for prescription in 2021, were, until then, excluded of the field of the judicial inquiry.
The decision is rare. The Versailles Court of Appeal decided, Tuesday, June 28, to extend the field of the judicial inquiry targeting Patrick Poivre d’Arvor, accused of rape by Florence Porcel, to facts which appear prescribed.
The 38 -year -old writer accuses the former journalist of having imposed a sexual intercourse in 2004 and a blowjob in 2009, which he disputes. The facts of 2004 were classified without follow -up in 2021 for prescription, those of 2009 for “insufficient evidence”. After this decision, M porcel was formed civil party at the end of November in order to cause the referral of a judge to investigate again.
This judicial information, led by an investigating judge in Nanterre, was opened in December for the facts of 2009 alone, which the defense of M me Porcel disputed before the Chamber of instruction.
By invalidating the ordinance of this judge on Tuesday, the court of appeal “allows the investigation to continue on all the facts” and to decide, in a second step, on their prescription or not, explained Wednesday a source close to the file at the France-Presse agency (AFP). The judicial inquiry will therefore extend to the facts of 2004.
The defense of Patrick Poivre d’Arvor “expects to have more precise elements before reacting and commenting, if necessary, a court decision which would free himself from the rules of prescription,” said his lawyer, Jacqueline Laffont, who confirmed that his client had not been heard by the investigating judge.

The “PPDA” survey began in February 2021, after the complaint filed by M Me porcel. During the four months of preliminary investigation carried out by the Nanterre prosecution, twenty-three women testified. The majority of the facts denounced being prescribed, the survey was classified without follow -up in June.
Other accusations against the former journalist appeared in the press, bringing at least twenty-seven the number of women who testified against him in the media or before justice. Two of them were minor at the time of the facts denounced.
Patrick Poivre d’Arvor challenged all the charges against him and has filed a complaint for slanderous denunciation several times. After a first classification without follow-up, the former star of the 20 Hours of TF1 recently filed a complaint against sixteen of his accusers, this time with the constitution of civil party in order to cause the referral of an investigating judge. This judge has not yet been designated, because the complaint is at the stadium of consignment.
“ppda” has appointed these sixteen complainants as “excavated or very bitter ignored lovers” who act “in revenge” in “screaming at wolves”, according to his complaint, consulted by AFP. Patrick Poivre d’Arvor is also targeted by another investigation, led by magistrates from the Nanterre prosecutor’s office, following three rape complaints, attempted rape or sexual assault. The complainants denounce the facts which would have taken place at the Cannes Festival in 1985, in his office at TF1 in 1995 or in a club Med in Savoy in 2013. These facts also appear prescribed.
