Of the approximately 2,600 victims identified, 94 % were proposed a final settlement. But hundreds of litigious files are still pending before the courts, due to the lack of an agreement with the guarantee fund, as essential as disputed for the complexity of the procedures and the violence of certain expertise.

At the start of the trial of the attacks of November 13, Faustine Dréan had still not completed her compensation journey as a surviving victim of the Bataclan and companion of Jean-Jacques Kirchheim, died the same evening in the same place. Nine months later, while the pleadings of the civil parties are in full swing and the trial soon affects its end, this 40 -year -old woman finally has a compensation proposal. But his journey is not finished.
Throughout the trial, the painful question of compensation crossed the debates, arising during the testimonies of civil parties. Marylin (the civil parties have often asked that their name not be mentioned), present at the Stade de France, spoke of his “setbacks” with the warranty of victims of acts of terrorism and other offenses (FGTI): ” The galleys on everything, the expertise, a need for constant justification which is very painful to live. “Laura, present at the Bataclan, spoke of” real sessions of inquisition, judgments, questionable interpretations “of the FGTI. François, present at the Comptoir Voltaire, described the FGTI as “inhuman”.
“Fighter course”
M e Isabelle Teste, lawyer for several civil parties, even devoted her pleading to the “violence” of the victims’ journey, notably before the Guarantee Fund: “To the violence of the facts ‘Quickly add the violence of their journey, their fight. It is a real obstacle course, a rough, violent fight. This step [the FGTI] is sometimes cruel for the victims. “
The lawyer continues: “Some FGTI experts have been perceived as heinous (…):” Was you good? Have you kept your entry ticket? (…) You stayed a quarter of an hour at the Bataclan, it’s not long, it’s going to go. You can no longer work? But you are young and graduated, it’s going to go. You have moved ? It is a personal choice, it was you who decided it, it has no connection with the attack. (…) Have you aborted? But did you want to have a child? You can no longer go to the restaurant, to the concert, in public places? But did you do all this before the attack? “You have to justify everything, to restore, to discuss. The experience of the victims is disputed. Its scale is disputed. Its consequences are disputed. The victims feel despised, flouted, exhausted. is an additional violence experienced by each of them. “
President Périès defended the FGTI, recalling that “there have been quite indelicate people” having pretended to be victims. Despite this avalanche of criticism, everyone agrees on the usefulness of the FGTI and its necessary sustainability. France is, in fact, the only country in the world to have such a mechanism, created in 1986 on the initiative of Françoise Rudetzki, the president of SOS attacks, died on May 17. Extending to victims of road accidents and other offenses, this fund is supplied by a direct debit of 5.90 euros on each insurance contract.
