A small delegation of French investigators, including forensic physicians, should soon be at work in the kyiv region. After the discovery of civilians executed by soldiers, especially in Bindcha, France offered its help to contribute to the atrocity investigations that occurred during the Russian occupation.

Tuesday, April 5, Emmanuel Macron and Volodymyr Zelensky addressed the subject during a remote interview. The Ukrainian President came, a little earlier, to denounce, during a videoconferencing intervention before the Security Council of the United Nations, the “war crimes” committed by the Russian troops, of the acts discovered during their precipit around the capital. Mr Macron emphasized “the availability of France to support international justice and contribute to the work of investigating and documenting violence against civilians, to ensure that Russia returns to accounts”.

Unlike Joe Biden, who qualifies Vladimir Putin of “war criminal”, the head of the French state does not take up this qualification in his account, but is placed, according to his entourage, on an “operational plan” “:” There is the fact of saying, it’s good, but at the end is a judicial process and we put ourselves on this ground, on the ground of action, of the operational, to truly help Ukraine. “To put in place as soon as possible this cooperation, contacts took place between the Ukrainian General Attorney, Iryna Veediktova, and the French Ministry of Justice.

This assistance is to be distinguished, even if the steps can be completed, from the support provided by Paris to the investigations launched by the International Criminal Court (ICC), from the Hague. Seized by 39 States Parties, including the countries of the European Union, the Attorney General of the ICC, the British Karim Khan, opened in early March a survey of the acts committed by the Russian forces since the triggering of the invasion of the ‘Ukraine. If kyiv has not ratified the Rome Convention creating the ICC, the Ukrainian authorities have recognized the jurisdiction since 2014, for facts going back to the war in the Donbass.

Due to lack of resources, the Court of the Hague relies on the support of the States that seized it to carry out its work. Paris should thus put at its disposal various experts, two magistrates and ten gendarmes to start. It was also decided to earn the French contribution to the budget of the institution founded in 2002 (ie 13.3 million euros), while paying out exceptional aid (490,000 euros). French support will also be able to take the form of information, which is essential for advancing the investigations and seek people suspected of committing crimes. France is broken on this kind of cooperation with the ICC: it is the main contributor of its various investigations in Africa.
