Plague thesis: disciplinary decision of Paris-I university “tainted with illegality”

Suspected of having plagiarized his thesis, lawyer Arash Derambarsh obtained from a court of appeal the cancellation of the disciplinary decision of first instance. At this stage, it is however suspended for plagiarism of “any higher education establishment” for five years.

The alleged plagiarism affair of the thesis of sustained law, in December 2015, at the University of Paris-I-Panthéon-Sorbonne, by the lawyer and elected (Les Républicains) de Courbevoie (Hauts-de-de Seine) Arash Derambarsh is experiencing a new twist. In a decision taken on March 14, the National Council for Higher Education and Research ruling in disciplinary matters (CNEser) canceled the decision taken, in July 2020, by the disciplinary section of the Academic Council of the Paris- University- I.

At first instance, the disciplinary section had definitively excluded the lawyer “from any public higher education establishment”. She had canceled the test of defense of the thesis and withdrew the doctoral diploma to Mr. Derambarsh, a bridge which had given her access to the school of the bar.

While Mr. Derambars had appealed, the CNEser said that the university’s disciplinary decision was “tainted with illegality”. The National Council, however, concluded that the lawyer “carried out on more than a hundred pages of his thesis (…)” copy and paste “of his many sources without quoting them in the text or in the footnote” and put in exerts “the faulty behavior attributable” to Mr. Derembarsh. The latter is thus excluded from “any higher education establishment” for five years and the defense test is canceled.

In its nine pages decision, the CNEser makes several grievances to the disciplinary jurisdiction of the University of Paris-I. He accuses him of having violated the secrecy of the investigation, the decision of first instance having been “illegally addressed to third parties who revealed the content”.

The CNEser accuses the disciplinary section of having considered “in his decision”, on the basis of “materially inaccurate facts”, “that Mr. Derambarsh had delivered to the investigating magistrates and to the jurisdiction of the falsified versions of his thesis for Hide the plagiarism “. He observes that the jurisdiction has “taken up” in the “content” of the decision “the distortion of the nature of the remarks made during the investigation” by Professor Bruno Dondero, thesis director of Mr. Derambarsh.

The denaturation of Professor Dondero’s words pushed Mr. Derambarsh filed a complaint with constitution of civil party, in 2021, for “false and use of fake in aggravated public writing” against the university and the eight members of the Disciplinary section.

The CNEser finally criticizes the faculty for having “brought no explanation” as to the disappearance “of the defense report, which was not found in the file among the hundreds of theses lost by the University of Paris-i “.
