Conflict associated with postgreSQL trademarks remains not resolved

It is noted that September 14, 2021, the day after the public announcement of the conflict caused by the fact that the Fundación PostgreSQL organization registered in Spain “PostgreSQL” and “PostgreSQL Community” and submitted an application for the registration of similar trademarks in the United States and European Union, representatives of PostgreSQL Core Team managed to negotiate with Fundación PostgreSQL. The Fundación PostgreSQL organization stated that it will begin the process of transferring PGCAC of all brands and domains for free and without any conditions.

7 months have passed since then, but the agreement on the transfer of trademarks remains inconsistent. The stumbling block was the intention of organizing PGCAC to compensate for the costs incurred during attempts to challenge the submitted bids for trademarks. The PGCAC organization did not achieve full reimbursement of legal support costs, but demanded to compensate the amount of duty for filing an application with an objection to the registration of a trademark. The Fundación PostgreSQL organization refused to pay such costs, explaining its solution to the fact that they could be avoided if the PGCAC tried to resolve the issue during direct negotiations without attracting a law firm.

In the process of discussing the draft agreement, Fundación PostgreSQL rejected most of the conditions for resolving the conflict and suggested adding several of its conditions, but continued to argue that in any case the application will responds to trademarks, regardless of the conclusion of the official agreement. Ultimately, the preparation of the agreement stalled, the applications for trademarks still remain not withdrawn, and the lawyer of Fundación PostgreSQL pointed out that the organization was not interested in carrying out this promise to revise trademarks (probably it was implied to refuse to refuse trademarks before signing the official agreements).

PGCAC representatives called on Fundación PostgreSQL to bring to the end of the conflict resolution and fulfill promises to review trademarks and transferring domains to close this question and focus on solving other project tasks.
