In the cities concerned by the supervision of rents, such as Paris, Lille or Lyon, the maximum rent will have to be indicated by the real estate agent on the rental announcement.

Lyon, Villeurbanne, as well as eighteen cities of Seine-Saint-Denis, like Montreuil, Bagnolet, Aubervilliers or Saint-Denis: in 2021, no less than twenty communes started supervising rents, thus joining Paris and Lille, who had started in 2019 and 2020.

In all these communities, where there are ceiling prices, rental real estate ads must evolve from 1 er April 2022 if they are issued by real estate professionals. In addition to the monthly remedy asked in wholesale, the announcement must indicate the mention “Submissive revenue zone”, give the rent “basic” (still called “Reference rent”) and the “reference rent”, That is, the maximum rent authorized excluding special cases (it corresponds to the reference rent plus 20%).

If the owner wishes to apply a rent supplement, the announcement will indicate the words “Rent complement” and the amount of the latter.

These elements, fixed by the Decree of January 26, 2022 on consumer information by professionals involved in a real estate transaction, must better inform the tenant upstream and emphasize how much it could happen, in the case where there is a complement to rent. And deter the owners from applying these supplements, giving them visibility.

For the moment, these rules are necessary only to real estate professionals, but the ads broadcast by the individuals must also be submitted very soon – an application text is expected shortly, according to the services of The housing minister, Emmanuelle Wargon.

Three months to challenge

“The goal is also that tenants are more likely to exercise their appeal opportunities. But they do not, because they are afraid of not finding housing or do not want to conflict with their owner”, think Corinne Jolly, president of director.

The tenant may, in fact, dispute a supplement to rent three months after the lease signature before the departmental conciliation commission then in court. State services can also verify the application of the text, with a fine of a fine of up to 5,000 euros for a natural person at 15,000 euros for a legal person. The Ministry of the Economy hopes that the particulars indicated in the announcement will help its services better control the housing rented above the ceilings.
