The buyer of Whirlpool in Amiens, Nicolas Decayeux, was sentenced Tuesday, February 1 by the correctional court at ten months of suspended prison and 25,000 euros fine for biennial abuse and bankruptcy. At the hearing on December 9, the prison had required eighteen months in prison.
The lawyer of Mr. Decayeux, Pascal Lévy, reacted:
“I wait to see the motivations of the deliberate and to talk to me with my client to see if we appeal the decision. The sentence is heavy (…), I will see in what state of mind is my Customer, knowing that he may want to shoot a judicial page and find some tranquility. “
m. Decayeux, who has refused to comment at the end of the decision, had taken over in 2018, via his company WN, 162 of the 282 employees of the Whirlpool site, after the relocation of production in Poland. But WN had a liquidation a year and a half later.
“I think I’m a talent”
He had explained during his trial that this project had capped because the public authorities and the company had not honored their financial commitments. “I had quantified the project at $ 21 million. I received only 9 million,” he argued.
Among the grievances that are reproached for him, the increase of his remuneration at more than 20,000 euros per month, as well as a premium of 25,000 euros. Figures deemed to be problematic by the judicial administrator and the liquidative agent, given the turnover: 250 000 euros in 2018.
m. Decayeux had replied:
“I think I’m a talent. I think I had that level. On the premium (…), I may not have owed, even if I feel that I meritais. “
The former Strategic Director of WN, which has become his companion at the time, was sentenced for the concealment of corporate abuse for perceived a premium. The confiscation of some € 20,000 on its bank accounts has been pronounced.
Whirlpool had become a presidential totem in 2017 after a duel-surprise on the fate of the site in Amiens between Marine Le Pen and Emmanuel Macron. At the end of November, Mr. Macron felt that WN had “behaved like a premium hunter”. “I made myself with you,” he had told former employees.
