The Russian authorities compiled a list of countries and jurisdictions, “unwanted” to create holding companies that accumulate enterprises located in Russia, write “Vedomosti”. It includes 13 countries that did not appear in the previous similar lists.
The new list includes three countries of the European Union (Cyprus, Malta and Ireland), a separate region of another EU country (Portuguese Island of Madeira), as well as Switzerland, Hong Kong, Singapore, Montenegro, Sri Lanka, Lebanon, Curaçao (state in Caribbean) and Tonga (Kingdom in Polynesia). Separately, the list shows two states of the United States (Wyoming and Delaware) and the American Virgin Islands, which have the status of a non-coordinated United States territory.
The rest of the list participants and were previously recognized by Moscow offshore jurisdictions, for example, British Virgin and Bahamas. At the same time, some countries have not entered the list with which Russia in 2020-21 revised the terms of tax agreements, in particular, Luxembourg and the Netherlands.
It is expected that the new list will be used when making decisions on the provision of state support. Companies, 25 percent and more residents belonging to the list of list, will not be able to count on the aid. The new rule will come into force from 2023. Currently, assistance is not allowed to companies, by 50 percent and more belonging to owners from offshore.
In 2020-21, Russia revised the terms of agreements on the avoidance of dual taxation (Sydin) with several countries most frequently used for transit capital transit through dividends and interest. Now such payments are taxed by the source (in most cases – in Russia) at a rate of 15 percent. Among the countries of Cyprus, Malta, Luxembourg. The appropriate agreement with the Netherlands was denounced.
