The Constitutional Court adopted the complaint of the military pensioner Pavel Pedelkov, challenging the right to the social benefits unclaimed for several years, “Vedomosti” write. Now the court must solve the fate of this kind of payments.
REDELECTS for 15 years, from 1982 to 1997, served in the Kazakhstan city of Baikonur, on the rent of Russia, the cosmodrome, after which he retired. In the future, the plaintiff faced difficult life circumstances, several times was brought to administrative responsibility for the emergence of in public places in a drunk and lost his passport, which later managed to restore.
Return to the normal life of REDELKOV was only in 2016, after which he turned to the bank for his pension to him. However, in the credit institution stated that a pension was ceased to charge another 10 years ago – due to the fact that he did not remove it from the account for six months in a row.
Application of Pedelkov was able to restore payments for the previous three years, but the rest of the money, about 2.5 million rubles, could not be returned. The courts of general jurisdiction denied the military pensioner in the requirements, after which he appealed to the Constitutional Court.
Representatives of Pedelkova note that the removal of pension from the account is right, not a duty, and emphasize that the Ministry of Defense could learn about the state of the pensioner’s account only by extracting on it, which is a violation of bank secrecy. According to lawyers, the outcome of the case of Pedelkova can further affect similar situations with any benefit paid benefits.
