Families without papers evacuated in Clichy: Council of State orders their relocation to town hall

The mayor of the city had felt that the relocation of people in an irregular situation was the responsibility of the State.

The Council of State ordered the Town Hall of Clichy (Hauts-de-Seine) to urgently relocate families in an irregular situation that had been evacuated in 2020 of a building as a result of a peril decree imminent, according to his decision consulted by the France-Press agency (AFP) Monday, January 3rd.

The Council of State, seized by the Mayor Rémi Muzeau (LR), had to re-examine the decision of the Administrative Court of Cergy-Pontoise, who had already enjoined, in August 2021, to Mr. Muzeau to relocate the families urgently in an irregular situation that had children.

In October 2020, about fifty inhabitants of a building evacuated as a result of an imminent peril arrest had claimed to the town hall and the state a relocation solution, the owner being defaulting. Among them were some families in an irregular situation representing about fifteen people. The Mayor of Clichy had felt that the relocation of the people in an irregular situation was the responsibility of the State.

But in August 2021, the administrative judge considered that he existed “serious doubt as to the legality of the decision” of the Mayor and had forced him to relocate the families with children. Mr. Muzeau had appeared in cassation against this decision. On December 30, the Council of State declared the appeal of the mayor ineligible.

“This means that the arguments, which are not serious, will not be examined further,” said AFP M e Lucile Abassade, avacuated families lawyer. “The Council of State recalled that in case of evacuation, when the owner is faulty, it is the mayor to relocate people, whether or not they have a residence permit.”
