Brussels believes that Poland “violated general principles of EU law” and launches a procedure

The European Commission launched, Wednesday, December 22, an infringement procedure against Poland following the judgment in October by the Constitutional Court of this country disputing the primacy of European law.

“We consider that this case-law has violated the general principles of autonomy, primacy, efficacy and uniform application of the law of the Union, and the binding judgments of the Court of Justice [of the Union European]. We also consider that the Constitutional Court no longer meets the requirements of an independent and impartial tribunal established by the Act, as required by the Treaty “of the European Union,” said European Commissioner for the Economy, Paolo Gentiloni.
