The financial situation of the former Secretary General of the Elysée required a new hearing, at the end of which the National Financial Prosecutor’s Office has arosented his requisitions, claiming a one-year sentence in prison.

The trial of the Elysée’s polls would definitely accumulate legal rarities. Three weeks after its fence, the 32 Chamber of the Criminal Court of Paris reopened the debates, Friday, December 3, due to new elements concerning the financial situation of Claude Gueant, one of the main Accused of this case of contracts passed without tender with girlfriends by the firm of Nicolas Sarkozy between 2007 and 2012.
The National Financial Prosecutor’s Office had initially required one year in prison, including six months of staying and 10,000 euros of fine against Mr. Guéant, considered the main authorizing officer of these contracts with the companies of Patrick Buisson and Pierre Giacometti . But the court was not aware of other judicial decisions concerning the former Secretary General of the Elysee.
Heritage survey
In 2015, the latter had been condemned in an other case, that of the liquid premiums paid within the Ministry of the Interior. Mr. Guéant had touched, while he was Minister of the Interior, 5,000 euros monthly taken from the funds for police investigation, for a total of 105,000 euros. Convinced of diversion of public funds, he had been sentenced to two years in prison, including one with probationary stay and 75,000 euros fine for diversion of public funds. A sentence confirmed on appeal in 2017, and final with the rejection of his appeal in cassation in 2019. He was also required to pay 105,000 euros of damages and interests to the State.
But Mr. Guéant has made the ear a little bit to solve this amount voluntarily, with a payment of 1,300 euros on the eve of a hearing. The sentence judge therefore ordered a survey of its heritage, entrusted to the Central Office for the Fight Against Corruption and Financial Offenses (OCLCIFF). Rendered in January 2021, she felt that the former minister would have, in the light of her accounts, could pay a more important refund. On the basis of these elements, the Chamber of Application of the Court of Appeal revoked, on 9 November, a portion of the stay and the conditional freedom granted to Mr. Guéant.
These elements had not been communicated to the 32 * Advertising Chamber at the trial of the Elysee’s polls. During the examination of his personality, intended to inform the Tribunal on his financial means in the event of a conviction, Mr. Guéant had expressed his difficulties, affirming to live with 1,600 euros per month, or the pension. was not punctured by the State to settle its fines.
