The Central Bank wanted to more actively smolden Russian credit institutions and expand the list of grounds for recalling licenses. The participants of the Association of Banks of Russia (ADB) came to this conclusion, who sent a letter to the chapter of the Financial Markets Committee Anatoly Aksakov, excerpts from which RIA Novosti leads.
The authors of the letter appealed to the new bill on the information platform of the “Know Your Client” created by the Central Bank, designed to combat money laundering. It is assumed that with the help of the service banks will be able to obtain information about possible risk in real time when conducting certain operations on behalf of customers.
The new approach involves assigning customers from among legal entities and individual entrepreneurs of one of three levels of possible risk and the corresponding color marks: green – with a minimum level, yellow – with an average and red – with a maximum. When transactions on the instructions of the “yellow” customers, banks must study the circumstances of operations in detail.
At the same time, credit organizations fear that the draft law under consideration by the State Duma will significantly expand the grounds for the review of bank licenses, without taking into account the “principles of justice and the proportionality of the violation and punishment for it.” The most risky for banks will be the failure to comply with the requirements of the Central Bank on the timely informing of clients about the risk-assigned to them. In fact, to assign one or another risk level will be the Central Bank, and the banks will be only intermediaries between it and customers, they write the authors.
At the same time, it is indicated in the ADB letter, banks will be in a more profitable position, which will not use the new system of assessing the Central Bank, since they will not be threatened with a license review. They will also be able to avoid operating costs to ensure the work of the new system.
In recent months, the Central Bank responded with a license from several banks, often motivating its decisions to violations of legislation to combat money laundering. In mid-October, the Arbitration Court of Moscow for the first time since 2015 recognized illegal deprivation of the License of the Krasnodar Bank “Southern Multi-Color Corporation”.
