First of all for tax debts, you can limit the owner to the opportunity to alienate and lay real estate. Next comes vehicles, securities and “office design items” (furniture, art objects), as well as other assets, but not finished products, raw materials and materials.
It is assumed that the new norms will soften the current procedure when the FNS arrests the company’s accounts, which leads to a stop and even business destruction. Meanwhile, the ban on the sale of assets will allow to stop their conclusion.
As noted in the material that has developed, the practice is such that after serious complaints of the FNS business is often starting to “settle”. For the output of funds, creditors are fighting, including banks, beneficiaries, and in some cases and state structures. This process loses the company themselves, and budget. The loss department for the year is estimated at 170 billion rubles.
The amendments will not touch the collateral in which the property was given prior to the start of the check. In addition, “arrested” assets can be replaced with the consent of the FTS, and the restrictions of other rights, except for the right of ownership and pledge, are not supposed.
At the same time, the authors of the bill tried to avoid corruption opportunities that the practice of “arrests”. Limit the owner in rights is only possible by the decision of the head of the FNS inspection with the consent of the head or deputy head of the Federal Tax Service. It is possible to remove the restriction using a bank guarantee for the amount of claims, the guarantee of a third party or independently give guarantees in the form of securities or property.
The preparing changes in legislation became known on the eve. Representatives of business and specialized organizations fear that the new powers of representatives of the FTS will be used primarily for pressure on entrepreneurs.
